Does anyone ever have problems if your frying tortilla shells floating up out of the basket or needing to be pushed back down?

I don't place the shell in the bowl, I place the shell in the oil and use the basket to hold shell. The shell forms to the basket and works very well. Don't hold shell to bottom of pan though.

Can this go in the oven?

Not effectively. It’s too tall for my oven unless laid down and then the tortilla falls out

Will this fit inside a typical hime deep fryer?

The basket is 8" diameter by 5" deep. The handle is 13" long. If your oil fills to at least 5" depth and has at least 8.5" diameter then it will fit just fine, otherwise it would be too large. Thank you

can this be used as a fry basket for Fry Daddy?

It is generally too deep for a fry daddy. This is a commercial basket . You can use it if you don't mind a portion of the backet sticking out of fry daddy. You would need to use smaller tortillas.
