I already ordered this toy for my sons cake but I see it has a battery. What does it have sound?

There is no batteries needed for this figure, it does not have a sound function. The battery listing is a site error.

I am a serious Marvel collector which means the boxes are never opened & are the most important part of my it. How is the box protected when shipped?

We can only speak to our process for our shop on this, of course. A figure like this would be wrapped in bubble wrap, and then packed in packing peanuts. If any windows on the box look to be in danger of collapse, we will sometimes wrap the windows in cardboard as well (but that's usually only necessary for the larger pieces.)

Fake as in what, like is the listing fake? If Amazon is listing it for the seller, I doubt it is fake. I bought this item on here myself and still have it to this day.

can these be mounted in cars? do they have a sticking base?

No sticky base but that doesn't mean you can't add double stick or some kind tacky adhesive. Hope this helps, Bizarro!
