Q: My mortise is broken, how do I know if 45degree or straight lock?

The only way to know for sure is to remove the handle and look. You probably have a better than 99% chance that you need the 45° one. The only time I ever see the 90ﾟ lock is when people buy the wrong one and force it to work.

Q: Does this include a key?

No, our unit did not include a key. It's for a patio slider (at least that's what we used it for) and locks by use of a lever going up or down (on the inside of your door) ~ No keys involved.

Q: What is the functional difference between the vertical and the 45 degree lever? If I put a 45 degree in a slot meant for a vertical what will happen?

The chance of you needing the 90 degree version are very small. I use these locks a lot, and I haven't used a 90 in many years. The only times I see them at all is when someone should have the 45 but buys the 90 by mistake. I would bet less than 1% of doors need the 90 degree version.
